Foreign Businesses Aren't Protected by U.S. Antitrust Law

American antitrust laws do not protect foreign businesses from anticompetitive conduct, even if the alleged illegal conduct occurred in the United States, a federal judge in Philadelphia has ruled. Travel agents in the Caribbean and Latin America claimed U.S.-based airlines conspired to reduce their commissions to a flat rate. The Sherman Act, the judge said, "does reach conduct outside our borders, but only when the conduct has an effect on American commerce."

Doctor's Death Ends Diet Drug Case

A Philadelphia judge has granted a defense motion for summary judgment in a case in which the doctor who prescribed diet drugs to a fen-phen plaintiff died before he could be deposed. Because the plaintiff has no way to show that her physician would not have prescribed her diet drugs had he received a different warning from Wyeth as to their possible side effects, she is "unable to establish that Wyeth's alleged failure to warn was the proximate cause of her injuries," the judge wrote.

The number of first-year associates entering the Philadelphia offices of local firms increased 2.8 percent between 2008 and 2009 as the economy didn't fall soon enough for some firms to realize they would have a drop in employment needs come this month, according to the results of The Legal Intelligencer's 2009 Philadelphia First-Year Associates Survey. And it was a mixed bag when it came to how many firms deferred associates, with seven of 15 firms saying they did defer associates by some time period.

A federal judge has rejected a proposed co-lead plaintiff for the Monster Worldwide Inc. securities fraud class action because the representative knew nothing about the case. Southern District Judge Jed Rakoff said the Steamship Trade Association International Longshoremen's Pension Fund was "simply the willing pawn of counsel" because it "has no interest in, genuine knowledge of, and/or meaningful involvement in this case."
