When thinking about the topic for this month's column, it occurred to me that it might be a good idea to speculate about what the election of Barack Obama might mean for the viability of a forum-selection column. It appears that the legal principles are becoming known and settled so that there is less need for appellate review. There also appear to be fewer problems, which means that there may be less need for the Obama administration to tinker with federal jurisdiction to referee the forum-selection game.
