Not All Personnel Records Protected By Peer Review Protection Act

Medical malpractice plaintiffs are entitled to discovery of a physician's hospital personnel records generated in the ordinary course of employment. Such records are not protected as peer review material, a Philadelphia court has ruled. The judge ordered St. Luke's Hospital to produce the applications for hospital staff privileges of Dr. Theodore Makoske, who treated an 8-year-old girl who allegedly died after being given the wrong drug.
