In a 6-to-5 opinion, the appellate court decided the biggest class action in U.S. history can move forward, allowing more than 500,000 female Wal-Mart employees to pursue back pay and injunctive relief against America's largest retailer. It's a huge win for Cohen Milstein and the Impact Fund--but Wal-Mart's Gibson Dunn lawyers are hinting at a Supreme Court appeal.

Last fall, we asked if time was on Wal-Mart's side as it battles the spate of regional employment class actions that were filed in the wake of the U.S. Supreme Court's decision in Wal-Mart v. Dukes. The company and its lawyers at Gibson, Dunn & Crutcher certainly think it is, and now they've gotten a second judge handling one of the mini-Dukes cases to agree.
