High Court Justices Greet 'Bilski' Arguments With Doubt, Disdain

U.S. Supreme Court justices from across the spectrum voiced skepticism Monday about whether intangible business methods and other innovations untethered to machines deserved patent protection. The comments, some of which bordered on the derisive, came in the long-awaited argument in Bilski v. Kappos, touted by some as the most important patent case in decades. Several attorneys predicted after the argument that the Court will look for a narrow ground for decision in the case.

Net Gambling Lobbyists Lose Big

Online gambling lobbyists lost a big hand Sept. 30, when Congress passed the Internet Gaming Prohibition and Enforcement Act, prohibiting financial institutions from making payments to online gambling sites, with certain exceptions. In the past five legislative sessions, bills banning online gaming have passed the Senate twice and the House once, but never at the same time. "The politics of the moment got the bill passed," said Frank Fahrenkopf Jr. of the American Gaming Association.

Milberg Weiss Attempts to Calm Judge's Ire

Harshly criticized by federal Judge Marilyn Hall Patel for its conduct in a stock drop suit, Milberg Weiss has fired back. The California judge had ripped the firm, suggesting it was an inappropriate choice for lead counsel in a stock fraud suit against Terayon Communication Systems because, in part, Milberg's client had a game plan to drive down Terayon's stock and Milberg appears to have hidden the short selling. The firm says the judge had been misled by defendants.

Legal fees, like other debts, are usually wiped clean in a Chapter 7 bankruptcy, but Jason DiBattista's $35,000 debt to his divorce lawyer, Gregg Sodini, was not typical. For one thing, DiBattista is himself a lawyer, concentrating in bankruptcy, and was once Sodini's colleague at Cuyler Burk in Parsippany, N.J. For another, Sodini contends he handled the divorce based on DiBattista's promise to pay the fees even if his precarious finances landed him in bankruptcy.

When the backers of California's stem cell initiative were seeking voter support, they not only promised cures for dread diseases, but also licensing revenue for the state. Prop 71, which will distribute $300 million in grants per year over the next decade for in-state stem cell research, passed with a 59 percent voter approval.
