Lawyer Count Drops in Some Top New York City Firms

The number of attorneys at leading New York law firms has dropped sharply. Attrition is on the rise, incoming associate classes are smaller, and the expanding job market has opened the door to opportunities at other law firms and in-house legal departments. In the past, high attrition left large firms understaffed. But so far the firms are able to handle their workloads. At least for the moment.

Nearly one year after the U.S. Food and Drug Administration issued a pre-emption on filing failure-to-warn actions over federally approved drugs, rulings across the nation show a clear division over the issue. Plaintiffs attorneys call the FDA pre-emption camouflaged tort reform, while defense counsel argue that the FDA should call the shots on drug safety matters, not judges and juries. Many expect a showdown before the high court.

U.S. Supreme Court Justice Ruth Bader Ginsburg made a confession recently: She doesn't read all the amicus curiae briefs filed before the Court. While appearing with Ginsburg at a panel discussion, Justice Sandra Day O'Connor indicated the same -- and said amici should file only when "they have something useful to say." Ginsburg singled out the "me too" briefs as well, saying, "I don't see why they don't consolidate." As she put it, "There are many friends of the Court -- sometimes too many to manage."
