Settlement Denied Enforcement; Counsel Lacked Authority, Plaintiff Never Agreed to Terms
Bankruptcy court granted a motion in limine regarding the admissibility of certain court opinions, but it denied the remainder of defendants' motions in limine.
Appellant appealed the judgment in favor of appellee in its action for conversion against appellant law firm that subsequently represented individual in lawsuit and dispersed proceeds of settlement to individual and court found appellant's conduct did not deprive appellee of the funds but rather provided individual with the funds he could have used to compensate appellee. Vacated and remanded.
Defendant lawyer and his law firm were liable for conversion where they distributed the proceeds of a settlement amount to their client without paying the plaintiff law firm's outstanding balance for work on the settled case, even where defendants did not retain the funds and believed they had done the right thing. The court recommended affirmance.
