Protecting Forests and Displaced Populations in Colombia

In his International Environmental Law column, Stephen L. Kass of Carter Ledyard & Milburn writes that, in human terms, deforestation presents direct threats to many indigenous communities, whose livelihoods and cultures depend on the forest, and exacerbates the migration of rural communities either toward their own nation's cities or, in lesser numbers, toward neighboring countries where they hope to continue their rural lifestyles.

Environmental Law

Stephen L. Kass and Jean M. McCarroll, partners at Carter Ledyard & Milburn, write that in the last six weeks, there have been three long-awaited actions on automobile fuel economy standards in the United States: the Ninth Circuit held the new corporate average fuel economy standards for light trucks were unlawful, a bill including the first increase in statutory fuel economy standards since 1975 was signed into law, and the EPA denied a Clean Air Act waiver to California's vehicle emissions standards.

Environmental Law

Stephen L. Kass and Jean M. McCarroll, partners at Carter Ledyard & Milburn, write that by integrating old and new proposals into a single vision for New York's environment, a vision intended to complement long-range commercial and educational goals, PlaNYC can help to advance an environmental justice agenda that has long been stalled. While there will still undoubtedly be gaps in the urban fabric, PlaNYC represents a serious promise from one generation of New Yorkers to the next to pass on a livable city.

Art Collector Loses Bid to Claim Title to $1 Million Lipchitz Sculpture

A Canadian art collector who claims title to a 1,100-pound sculpture by one of the 20th century's most acclaimed sculptors, Jacques Lipchitz, waited too long to file his court action, a unanimous New York appeals panel has ruled. A Manhattan surrogate had awarded "The Cry" to collector David Mirvish, who claims title through a companion of Lipchitz's widow. But the appellate court reversed, saying that Mirvish's claims were time-barred and that the artwork belongs to Hanno D. Mott, the son of Lipchitz's widow.

Paul Weiss, Greenberg Traurig, and Carter Ledyard Advising on West Side Deal Redux

If at first you don't succeed, pray that there's another billion-dollar real estate bid to pick from. That was the option presented to New York's Metropolitan Transportation Authority when a $1 billion bid to develop a 26-acre tract of land the MTA owned on Manhattan's West Side fell through a week ago. On Monday the state agency announced that it had a new $1 billion deal with The Related Companies and its partner Goldman Sachs for a 99-year lease to develop the site.
