A Canadian art collector who claims title to a 1,100-pound sculpture by one of the 20th century's most acclaimed sculptors, Jacques Lipchitz, waited too long to file his court action, a unanimous New York appeals panel has ruled. A Manhattan surrogate had awarded "The Cry" to collector David Mirvish, who claims title through a companion of Lipchitz's widow. But the appellate court reversed, saying that Mirvish's claims were time-barred and that the artwork belongs to Hanno D.
