Law Firm Leaders Express 'Guarded Optimism' About Business Outlook for 2011

When managing partners of law firms large and small gathered in the same room last week at Patterson Belknap Webb & Tyler, the inevitable question arose: Will business get any better? A straw poll conducted at the meeting revealed "guarded optimism," according to a New York State Bar Association task force. Of the 21 law firm leaders who participated in the survey, only two said they expected legal business would decrease in 2011, with the rest predicting flat to modest growth.

'Napster' Fallout

It's been nearly a year since the 9th U.S. Circuit Court of Appeals ruled in A&M Records v. Napster Inc. -- in which the record industry sued a popular song-swapping service for piracy. The 9th Circuit upheld a preliminary injunction that effectively put the free-wheeling Web site out of business. But Napster, which was remanded to the district court, continues to spin out interesting legal issues.

To find out how Midlevel associates rate their firms as workplaces, our annual midlevel survey examined 12 areas that contribute to job satisfaction. They include relations with partners and other associates, the interest and satisfaction level asso-ciates have in their work, training and guidance, policy on billables, management openness about firm strategies and partnership chances, the firm?s attitude toward pro bono work, compensation and benefits, and the respondents? inclination to stay at their firm for at least two more years. Respondents graded their firms on a scale of 1 to 5, with 5 being the highest score. On this chart, firms with ten or more responses are ranked by their averages on those questions. Environmental Group Wins Fees from EPA

Two attorneys who challenged the Environmental Protection Agency to impose pollution standards for New York State reservoirs should be awarded fees under the Clean Water Act, a federal judge in New York ruled. The ruling was based on a provision in the act allowing judges to award fees for successful "citizen supervision" cases in which plaintiffs suing under the act achieve "significant" results.

Law Firms See an Array of Fates After Sept. 11

In the five years since the terrorist attacks on the World Trade Center, all sizes of law firms in New York have been picking themselves back up. Some law firms have returned to the downtown area, but many others have opted to start over in areas less scarred. Some, such as immigration solo H. Taufiq Choudhury, have faced bureaucratic red tape in re-establishing their practices, while others were able to return due to relatively low market rates and through federal and local incentive programs.
