Abandonment Must Be Sexual, Not Social, to Divorce, N.Y. Panel Says

Despite its recognition of the "frustration" among matrimonial attorneys regarding New York's continued status as the only state in the country without no-fault divorce, a Brooklyn appellate panel has declined to broaden the grounds for divorce by recognizing a "social abandonment" cause of action. The plaintiff argued that her husband's refusal to eat meals with her, celebrate holidays together or attend family functions should be recognized as a form of abandonment, one of the four grounds for divorce.

Comcast suffered a significant setback last week when a federal judge refused to dismiss a class action antitrust suit that accuses the company of setting out to establish monopolies in the Philadelphia and Chicago markets, then increasing prices once it had eliminated all the competition. N.Y. Lawyer Misconduct Fund Braces for Surge

Dishonest attorneys prompted the awarding of $7.1 million in 2006 from the New York Lawyers' Fund for Client Protection, which warned on Thursday that the fund is likely to start seeing claims from the largest case of lawyer theft in its 25-year history. Officials say the fund's finances are "very strong," but claims for reimbursement from clients defrauded by Andrew F. Capoccia and two attorneys working for him in his debt-reduction practice could total $5 million to $6 million alone.
