Judge: Private Cause of Action Exists for Involuntary Servitude

Nearly 140 years after the passage of the 13th Amendment, abolishing slavery, a federal judge in New York ruled that an implied private right of action exists for involuntary servitude. U.S. District Judge Nicholas Garaufis refused to dismiss claims brought by a domestic employee who alleges she was held prisoner by a New York couple, saying that Congress intended to allow private parties to sue for being held in bondage when it criminalized slavery.
