Defense Win in 'Apology Note' Med-Mal Case

A Pennsylvania jury has returned a defense verdict in a failure-to-diagnose case brought by a woman who later died of colon cancer at the age of 81. Prior to the suit, gastroenterologist William Mahood had written a letter to Meye Blom in which he apologized that a colonoscopy had failed to identify her ultimately fatal tumor. "I tried my best but clearly missed this tumor. I hope you can forgive me," he wrote. Mahood's attorney said his client didn't write the letter "to prevent litigation."

The denial of emeritus status to a retired Fashion Institute of Technology professor who claimed retaliation for criticizing school policy cannot be considered an adverse employment action, a New York federal judge has ruled. The judge said professor Martin Zelnick had failed to offer enough evidence to sustain a claim of wrongful retaliation for the exercise of free speech rights because the school's refusal to name him professor emeritus did not result in the denial or loss of tangible benefits.
