By a 4-1 vote, a state appeals panel has reinstated a malpractice complaint against an immigration attorney who allegedly offered incorrect advice about a visa matter that would have put a client at great personal risk. The Appellate Division, First Department, ordered the case to be reinstated to weigh claims that the attorney should have brought forth evidence that his client's dilemma was caused by "an unlawful and vindictive act by an employer," which had engaged in "benching" against him, i.e., firing him but retaining his immigration documents so he could not seek alternate employment.
