Judge's Error on Juror Literacy Could Overturn Porno Conviction

A rarely utilized federal statute requiring all federal jurors to be literate may win a new trial for two former Georgia educators convicted two years ago of child pornography. During jury selection in the 1997 trial, defense lawyers demanded U.S. District Judge Duross Fitzpatrick refused to strike one potential juror after the panelist professed that he couldn't read everything on the jury questionnaire. Now, a three-judge panel of the 11th U.S. Court of Appeals has held that Fitzpatrick was wrong.
