A federal appeals court Tuesday revived a securities fraud action against Merck that accuses the pharmaceutical giant of hiding the truth about Vioxx, a pain reliever that was withdrawn from the market in September 2004 because of concerns that it caused heart problems. But a dissenting judge said she agreed with the lower court's decision to toss the suits out on statute-of-limitations grounds because the investors waited more than two years after the first "storm warnings" that Vioxx was unsafe.
