Companies, courts debate whether ADA applies to Web sites
Does the Americans with Disabilities Act apply in cyberspace? Without clear guidance from the courts, companies are deciding for themselves. Some businesses have taken steps to make their Web sites more accessible to the disabled. But others have said that while they'll voluntarily alter their sites, they aren't required to do so by the ADA. RadioShack recently reached an agreement with advocates for the disabled. The Supreme Court on Dec. 3 refused to consider an appeal by an online publisher that claims credit-card companies are enabling the piracy of its pictures of nude models. The case was brought by Perfect 10 Inc., which until recently published an adult magazine and also operates Perfect10.com. IBM alleged in two lawsuits Monday that important components of Amazon.com's retailing Web site were developed and patented many years earlier at IBM. Hundreds of other companies have licensed the same patents, and IBM has tried to negotiate licensing deals with Amazon "over a dozen times since 2002," according to John E. Kelly III of IBM.
