Dukes like a cudgel, wiping out class claims in discrimination, consumer, and even toxic tort cases on the grounds that the proposed classes couldn't meet the commonality requirements set forth by the Dukes court. Bay Area law firms have tried just about everything to make it in New York. Three newcomers have employed vastly different tactics and, so far, are seeing varied results. Pillsbury Madison & Sutro took the biggest leap by merging in 2001 with Winthrop, Stimson, Putnam & Roberts. Heller Ehrman White & McAuliffe started smaller but has been growing steadily.
