Appeals Court Revives Hope for Junk Fax Class Action

The Georgia Court of Appeals has revived a junk fax case that involves 73,500 faxes and potential fines of $110 million. A Gwinnett judge had denied class action status to the unwitting recipients of unsolicited car wash ads because he found that plaintiffs' counsel didn't do enough to prove people who got the fax constituted a class. The appeals court has granted a request by plaintiffs' counsel for an interlocutory appeal on the class issue.
