After all, the district's construction contracts have spawned criminal charges against former top school officials and a civil suit against the school district by its former construction management companies that has already cost it more than $20 million to defend.

Look for the GOP Label

In the Nov. 5 general election, Steven Wayne Smith -- a political outsider who turned off Republican financial backers by beating an appointee of Gov. Rick Perry's in the GOP primary last March -- easily defeated Democrat Margaret Mirabal for Place 4 on the high court. Smith's win proves that money and endorsements -- of which he had little -- are less important than the party label in Texas' statewide judicial races, several political analysts say.

Conway v. The Cutler Group, Inc., PICS Case No. 12-2102 (Pa. Super. Nov. 5, 2012) Mundy, J. (16 pages).

In this case of first impression, the court found "no logical reason to limit a builder's implied warranty to his immediate vendee" and extended it beyond the initial user-purchaser of a home to a subsequent purchaser; privity of contract was not required and the risk of latent defects affecting habitability remained with the party who built the home. Reversed.

Associates Survey 2008

Smaller firms often outscore larger ones on our annual survey of midlevel job satisfaction. It may be because a more intimate atmosphere breeds happiness. Maybe it's because associates have more responsibility. Perhaps it's because they have a better chance of making partner. In these charts, firms are grouped roughly according to size. In the first category are firms whose annual gross revenues are too low to qualify for the Am Law 200. These are the smallest firms that took part in our survey. In the second category are Am Law Second Hundred firms?numbers 101-200 on the most recent Am Law 200 survey (July.) In the final category are firms that appear on our most recent Am Law 100 (May) or Global 100 (October 2007) survey. For a full methodology, click here.
