Ruling Eases Way For Liability Suits Against Georgia
Georgia's Supreme Court cleared the way for more liability suits against the state, ruling that a father can sue over the death of his daughter who was in foster care. The 2-year-old girl drowned in her foster parent's pool. At issue was whether the state could be liable for the death. The state is shielded from many tort claims through legislatively enacted sovereign immunity. But the unanimous decision means the natural father may take his $1 million claim to a jury.Merrilly Lynch & Co., Inc. v. Allegheny Energy, Inc.
