Justices Clear Air on Big Tobacco's Liability

The California Supreme Court exposed tobacco manufacturers to potentially enormous liability Monday by giving smokers greater opportunity to sue for physical ailments that might have started decades ago. Manufacturers claimed partial victory by saying the court maintained manufacturers' immunity in the 1990s. But opponents point out the court also held the immunity period doesn't protect them from claims arising from tobacco additives.

A decision by a U.S. District Court judge in Washington state that individual Roman Catholic parishes own their churches and schools does little to resolve the vexing legal issue of church property and adds another dimension to court battles pitting the church against sex abuse victims. Judge Justin Quackenbush also refused to make a blanket determination that each parish property was free of liability from the sex abuse cases, setting up the possibility of protracted discovery and further litigation.
