Sabel, a partner at Shearman & Sterling, writes that because the supervision function is not as objective as the regulatory function, it is harder to perform than it is to design and issue regulations, and harder to enforce. It may be that no significant change to the current system of bank supervision will, or should, be made. However, the ultimate response to any challenge to the existing system is to ask whether the absence of a large examiner corps conducting regular on-site examinations would have made the current situation even worse. What would have happened if institutions thought that the chances of on-site reviews of their operations would not occur?
