Energy GCs in Motion

Very so often it seems as though half the lawyers in a given industry trade jobs. The utility business appears to be going through just such a phase lately, as companies across the sector reassess their needs. According to industry insiders, most energy companies are searching for seasoned lawyers who survived the 1970s energy crisis, the deregulation and subsequent consolidation of the 1980s and 1990s, and, most recently, the California energy crisis and corporate scandals like those involving Enron Corp.

U.S. Trustee Objects to Third-Party Releases in LandAmerica's Reorganization Plan

The U.S. trustee in LandAmerica Financial Group's Chapter 11 bankruptcy proceeding is objecting to the company's reorganization plan because it releases nearly everyone involved, including lawyers, from liability for negligent actions. In an objection filed in Virginia federal court last week, the trustee states that the releases do not comply with the bankruptcy code or case law. LandAmerica filed for protection in 2008 after its Section 1031 exchange business collapsed due to its auction-rate securities investments.

Virginia Bar Rule on GCs Still Under Construction

Just four months after it reopened its inquiry, a Virginia Bar task force appears no closer to resolving a controversy over its proposal to require all in-house counsel in Virginia to become members of the State Bar. The task force, responding to calls for more debate, convened a July 24 meeting, but no decision was made on the status of the proposal. Another meeting has been scheduled for Aug. 27.
