New York State May Be Solely Liable for Indian Land Claims

A federal judge in New York has rejected the state's argument in a massive Indian land claim matter that if the United States gains control of disputed territories it must compensate the state under the Fifth Amendment's takings clause. The state, which has already been ordered to pay nearly $248 million to the Cayuga nation, may now be on the hook for any damages awarded in a separate action involving the Oneida nation.
