A New York judge has refused to dismiss a suit alleging that Robert J. Ivanhoe, chairman of Greenberg Traurig's New York office and head of its real estate group, disregarded his "legal and fiduciary duties" by taking a personal financial stake in a competitor to a client that had invested in a multibillion-dollar Las Vegas real estate venture. The judge ruled that the principal investor of the client could derivatively sue Ivanhoe and the firm, and that a pending arbitration would not render the suit moot.

Bush chooses district judge for 3rd Circuit, with Reed Smith attorney as replacement

U.S. District Judge Gene E.K. Pratter has been nominated to take a seat on the 3rd Circuit and, in a rare move, President Bush nominated Reed Smith attorney Carolyn Short to replace Pratter on the Eastern District of Pennsylvania bench. Ordinarily, the nomination of a replacement for a district judge who is elevated to the appellate court comes after Senate confirmation. But in Short's case, Bush invoked a rarely used procedure to send her nomination to the Senate now, to replace Pratter "upon elevation."
