The Supreme Court refused Monday to directly consider whether the drug combination used in executions in the United States amounts to unconstitutional cruel punishment. The justices had already agreed to hear arguments in April in a case brought by Florida death row inmate Clarence Hill about the procedure for lethal injection challenges. Monday's decision, which came on a separate appeal by Hill's lawyer, has little practical significance because Hill's other case is pending.

Michael P. Maslanka says he doesn't make New Year's resolutions because, well, his resolve always dissolves. So, for 2011, he suggests taking a different tack: a reframing of how we think about employees and employers, a reprioritizing of what we consider important, a commitment to open our hearts and minds. His first suggestion: ditch the write-up and say to the employee, with real empathy, "Susie, how is it going?" If not so well, Susie will say so, and an amicable parting results.

Stop prosecutorial abuses

The past year has seen an epidemic of reports of prosecutorial misconduct. We've seen judges harshly denouncing over-zealous prosecutors in the KPMG case, the Tollman cases, the case against Representative Jefferson and the Duke lacrosse case. These cases, while wildly different, had one common theme: The defendants had the financial wherewithal to defend themselves. DOJ officials need to be much more aggressive, and refer cases to the Office of Professional Responsibility at the first hint of misconduct.
