State Tells Judge to Leave Dogs at Home

A Michigan judicial agency says a dog's place is in the home and has ordered a suburban Detroit judge to stop bringing pet terriers Lurch and Lizzard to court. Judge Norene Redmond said the dogs brought calm to the tense courtroom, but the state Court Administrative Office said the habit was not appropriate. Said a spokeswoman for the state Supreme Court agency, "Animals don't understand that court proceedings are not to be disturbed."

Supreme Court Refuses to Broaden Death Penalty Review

The Supreme Court refused Monday to directly consider whether the drug combination used in executions in the United States amounts to unconstitutional cruel punishment. The justices had already agreed to hear arguments in April in a case brought by Florida death row inmate Clarence Hill about the procedure for lethal injection challenges. Monday's decision, which came on a separate appeal by Hill's lawyer, has little practical significance because Hill's other case is pending.

9th Circuit Discovery Ruling Could Impact Other Cases

A 9th Circuit ruling Monday that marks a victory for prosecutors' tight-fisted discovery policy has the criminal defense bar cringing -- and could prove just as perturbing to the Northern District of California trial bench. With U.S. Attorney Kevin Ryan making street gang prosecutions a high priority, the panel's decision -- that prosecutors may retain privacy over much of their witness information -- could affect several cases and dozens of defendants, including at least four facing execution.

Work Matters: Ditch New Year's Resolutions and Reprioritize for 2011

Michael P. Maslanka says he doesn't make New Year's resolutions because, well, his resolve always dissolves. So, for 2011, he suggests taking a different tack: a reframing of how we think about employees and employers, a reprioritizing of what we consider important, a commitment to open our hearts and minds. His first suggestion: ditch the write-up and say to the employee, with real empathy, "Susie, how is it going?" If not so well, Susie will say so, and an amicable parting results.

Stop prosecutorial abuses

The past year has seen an epidemic of reports of prosecutorial misconduct. We've seen judges harshly denouncing over-zealous prosecutors in the KPMG case, the Tollman cases, the case against Representative Jefferson and the Duke lacrosse case. These cases, while wildly different, had one common theme: The defendants had the financial wherewithal to defend themselves. DOJ officials need to be much more aggressive, and refer cases to the Office of Professional Responsibility at the first hint of misconduct.
