The appeals court upheld a district court ruling rejecting the plaintiff's attempt to bring new evidence, a key reason why patent lawyers opt for a district court appeal instead of Federal Circuit review. Patent attorney Hal Wegner says what's spooked the patent bar is merely dictum: "A lot of people who are commenting on the case are seeing all sorts of ghosts and mirrors."
