An insurance company is liable for the actual loss to premises that resulted when a motorist ran into the insured's above-ground heating oil storage tank and caused an oil spill, but not for any contamination of the ground or groundwater, an appeals panel in Albany has held. The Appellate Division, 3rd Department found that the insurance policy from New York Mutual Insurance, which excluded contamination clean-up costs, covered the property's loss in market value that was not attributable to the spill.Labor Decisions at Risk as Justices Struggle With NLRB Authority
