But a judge who made a defendant put on his medical experts before the plaintiff's to accommodate the plaintiffs lawyer's vacation abused his discretion and deprived the defendant of a fair trial, a New Jersey appeals court says. "The appropriate resolution would have been to declare a mistrial, not to force the defense to present its case first," said the court.
