Given President-elect Obama's stated antitrust enforcement priorities, the DOJ will likely move substantively toward the FTC in the areas of merger and dominant-firm enforcement. Meanwhile, we are hopeful an Obama-appointed FTC chairman will serve as a moderating force and help restore procedural fairness at the agency.

The Supreme Court of Canada has brought some clarity to "transfer pricing"—an accounting method in which a multinational company charges for the products, IP licenses, and various services that it provides to a foreign subsidiary. On Thursday, in a win for Glaxo Smith Kline and its lawyers at Osler, Hoskin & Harcourt, the court ruled unanimously that the Canadian government had to take into account more than just the market price of a product when assessing whether a company's transfer pricing was reasonable.

King & Spalding matched Alston & Bird's $15,000 increase in associate starting pay Wednesday, but made no mention of pay increases for senior associate classes. The raise brings first-year partner-track associates to $145,000, effective Jan. 1. Recruiters predict King & Spalding will go on to establish a pay scale with less compression or a more merit-based system, where pay for more senior associates is tied to performance. Another option, said one: Pay bigger bonuses to midlevel and senior associates.

A review of bankruptcy rates in Delaware and the Southern District of New York shows that a handful of U.S.-based partners at Am Law 200 firms have inched above the $1,000 rate barrier, making bankruptcy work as lucrative as it was plentiful in 2008 and 2009. Over a 12-month period ending August 2009, there were more than 13,000 billing rate entries submitted by law firms in the nation's two busiest bankruptcy courts, according to a new database compiled by ALM Media.
