Calif. Justices Spurn Federal Lead, Keep Catalyst Fees
Rejecting federal precedent, the California Supreme Court clarified, but refused to abolish, catalyst fees in the state Thursday. The 4-3 votes affirmed that such fees -- awarded to parties whose suits result in changes beneficial to the public -- are permissible in private attorney general actions, but only if they are based on meritorious complaints and there has been a "reasonable attempt" to settle. Four major makers of hip and knee replacement devices have agreed to pay $311 million in fines to avoid prosecution for allegedly giving financial inducements to doctors who used their products. The deferred prosecution agreement imposes a five-year compliance period and subjects the companies to 18 months' federal monitoring. Another company elected to be monitored but refused to enter into a civil settlement.
