Record Companies Win Music Sharing Trial

The recording industry won a key fight on Oct. 4 against illegal music downloading when a federal jury found a Minnesota woman shared copyrighted music online and levied $222,000 in damages against her. The jury ordered Jammie Thomas to pay the six record companies that sued her $9,250 for each of 24 songs that the companies focused on in the case. The jury found that Thomas's infringement was "willful," which meant that it could have imposed much higher damages of $150,000 per violation.

The Georgia Court of Appeals affirmed the grant of summary judgment to Emory-Adventist Inc., d/b/a Emory-Adventist Hospital ("EAH"), in Laura Hunter's medical malpractice suit alleging that an emergency room physician failed to properly treat Hunter's husband for his heart condition, resulting in his death, holding that EAH did not employ the physician and it was protected from vicarious liability because it fully complied with Georgia law in posting a notice in a public area of the hospital regarding the independent contractor status of all or some of the physicians performing services.
