11th Circuit Bounces Attorney's Contempt Sentence Back to Florida Federal Judge

When Florida attorney Lee A. Cohn was caught representing a client after he was disbarred, U.S. District Judge William Zloch ruled that the attorney had committed a Class A felony and was subject to a maximum sentence of life in prison. Zloch ended up sentencing Cohn to 45 days and five years of supervised release. But now, the 11th Circuit has ruled that there is no such thing as felony or misdemeanor contempt of court and returned the case to Zloch for resentencing.

A woman's civil fraud complaint, filed this week in a Florida court, claims that her former lover, who she met on the dating Web site Match.com, was a "con artist" who saw her as a vulnerable mark and devised a plan to exploit her "kindness and resources" to the tune of almost $70,000. A law professor who's not involved in the case said such suits have a good chance of success, explaining, "It's a transaction of a sort. ... The fact that she might have behaved foolishly is merely a footnote."
