Martin Zohn and Joshua Thompson, parters at Proskauer Rose, write that secured creditors and asset purchasers in sales under §363 of the Bankruptcy Code received an ominous wakeup call recently in the form of a decision from a respected Bankruptcy Appellate Panel in the U.S. Court of Appeals for the Ninth Circuit. Prior to this decision, they note, the speed and flexibility of a 363 sale "free and clear of liens" had made it the procedure of choice in many ditressed situations, supplanting secured creditor foreclosures under state law and Chapter 11 plans of reorganization.

After practicing law in New Jersey for 57 years, Martin Burger learned something new: You can be reprimanded by the state Supreme Court for paying paralegals a percentage of fees on cases they bring in. He also learned the punishment could have been worse. In an order made public on March 5, the justices adopted the Disciplinary Review Board's finding that Burger capitalized on paralegal Lita Biederman's contacts in the Filipino community to generate immigration cases.
