Texas Supreme Court Hears Thorny Insurance Cases Including 'Frank's Casing'

The Texas Supreme Court focused on two thorny insurance issues in arguments last week. The court reheard Frank's Casing, in which it held that an excess insurer that disputes coverage but settles a claim can sometimes seek noncontractual reimbursement for the costs from the insured. Upon rehearing, the court considered if its holding unfairly shifted risks from the insurer to the policyholder. The second insurance case was Lamar Homes, which was handed off by the 5th Circuit.
