Due to a California Supreme Court ruling, out-of-state companies should be less reluctant in their home jurisdictions to challenge employees who have moved. Though the "first filed" rule will not bar an employer's preferred forum from hearing the case, if different substantive law may be applied in the two courtrooms, there will be a race to judgment.
