Good morning and welcome to Supreme Court Brief. The justices close their February argument session with one case—another challenge involving its 1971 Bivens ruling. We take a brief look at the case, where two former Supreme Court clerks will face off. And gun rights challenges are never far from the justices’ docket. The latest one–a challenge to California’s ban on high capacity magazines–was filed this week with Kirkland & Ellis partner Paul Clement as counsel of record. Clement also represents challengers to New Jersey’s magazine capacity ban which the justices have yet to grant review, and challengers to New York’s concealed carry restrictions which he argued in November.
