Good morning and welcome to Supreme Court Brief. Bankruptcy is again on the argument docket today. We take a look at arguments by an amicus in the case, the National Consumer Bankruptcy Rights Center. The "Jackson List" offers a historical tidbit about the late Chief Justice William Rehnquist, Justice Robert Jackson and President Richard Nixon. Plus, scroll down for some thoughts on the major speech case heard by the justices on Monday.

Imputing Fraud

The final week of the December argument session is a feast of sorts for bankruptcy lawyers. The justices heard one case Monday and a second case this morning.

This morning's case, Bartenwerfer v. Buckley, features three Justice Department veterans. Williams & Connolly partner Sarah Harris, a former clerk to Justice Clarence Thomas, served as deputy assistant attorney general in the department's office of legal counsel. Zachary Tripp, partner at Weil, Gotshal & Manges, is a former assistant U.S. solicitor general and clerk to Justice Ruth Bader Ginsburg. And Erica Ross is an assistant to the U.S. solicitor general and former clerk to Justice Elena Kagan.
