Welcome to this edition of Supreme Court Brief. The court will hear the first oral arguments of the new year on Monday to kick off its two week January session. The justices had been on a winter break since early December before returning this past Friday for their initial conference.

And some “break” it was. The first five-alarm fire to hit the court’s docket during its recess came from Special Counsel Jack Smith, who urged the court to bypass the normal appeals process and quickly decide whether former President Donald Trump is immune from prosecution over his efforts to overturn the election by peddling false claims of election fraud.
