Welcome to Supreme Court Brief. The Supreme Court returned from the holiday Tuesday to begin rounding out the January argument session.

Before taking the bench, the court issued the list of remaining orders from Friday's conference. As expected, the court declined to take up any additional cases beyond those announced on Friday afternoon. Among the list of now-discarded petitions includes an appeal from an Indiana school district represented by high court veteran litigator Paul Clement about school bathroom policies for transgender students. The court's denial leaves in place a  U.S. Court of Appeals for the Seventh Circuit order barring the school district from denying a transgender student's request to use the boy's bathroom.

The court heard oral arguments in two cases Tuesday, one of which—recapped here at the National Law Journal—centered on an attempt by landowners to sue Texas under the Fifth Amendment's "Takings Clause" for a highway construction project that resulted in extensive flooding on adjacent properties.
