The U.S. Supreme Court has made it more difficult for consumers and others to enforce their rights because of a series of technical, ideological decisions of which the public is largely unaware, according to a recent scholarly study.

And the public is unaware because the news media tends to provide much greater coverage to merits issues than to those technical, private enforcement issues, such as standing to sue, legal fees, arbitration, damages and rules of civil procedure.
