By the end of oral arguments Tuesday in Heffernan v. City of Paterson, New Jersey, lawyers and justices agreed on one thing: The case was really odd.
“This is a bizarre case,” said Thomas Goldstein of Goldstein & Russell. “It is bizarre,” Justice Antonin Scalia concurred. “Highly artificial,” Justice Samuel Alito Jr. added. “Like a law school hypothetical.”
