Even without the late Justice Antonin Scalia leading the charge, the U.S. Supreme Court showed on Tuesday it can rein in the administrative state and give property owners new pathways to challenge regulators in court.

The court’s unanimous ruling in U.S. Army Corps of Engineers v. Hawkes will make it easier and faster to challenge federal agency determinations in regulatory matters that previously were viewed as lacking the finality required by the Administrative Procedure Act before lawsuits can be filed.
