Criminal defendants are guaranteed the effective assistance of counsel. A certiorari petition to the U.S. Supreme Court asks whether that protection should apply in termination of parental rights proceedings as well.
In Vanessa G. v. Tennessee Department of Children’s Services, a mother who was represented by a court-appointed attorney lost the right to her youngest child after lengthy legal proceedings. The mother then argued that her lawyer was ineffective, but a divided Tennessee Supreme Court found that she could not raise that claim.
