Until the final count shows a clear winner of the 2016 presidential election, the specter of 2000′s Bush v. Gore haunts Election Day. Could it happen again, but this time before a divided 4-4 Supreme Court?
“I do think it could happen again,” said election law scholar Edward Foley of Ohio State University Moritz College of Law. “The good news is it’s unlikely to happen for another century or so.”
