Despite statements from top officials in Texas, county clerks statewide have an immediate duty to issue marriage licenses to same-sex couples after the U.S. Supreme Court issued a landmark 5-4 ruling that declared that state same-sex marriage bans are unconstitutional, legalizing same-sex marriage across the nation.

Texas Attorney General Ken Paxton called the ruling “flawed” in a statement. Paxton wrote on June 25 that his position was that the U.S. Constitution doesn’t give the right to marriage other than between one man and one woman.
