An Austin lawyer who was arrested in April for a hit-and-run that seriously injured a pedestrian now faces a third-degree felony indictment.

The indictment charges Brian Michael White with failure to stop and render aid. It alleged that he drove a vehicle that was in an accident that was likely to injure the victim, Ernesto Gonzales. White knew the accident occurred, but he intentionally or knowingly left the scene without giving information about himself, his vehicle or his insurer. White left without rendering assistance to Gonzales, although it was apparent that he needed medical care because he had serious bodily injuries. White also intentionally or knowingly failed to determine whether a person was involved in the accident, whether the person needed aid and whether the accident caused a serious injury, claimed the Aug. 14 indictment in Texas v. White.

Because the victim was injured but did not die, White's alleged offense would be a third-degree felony, punishable by two to 10 years in prison and up to a $10,000 fine.
