A client alleges his former lawyer took advantage of him by trying to acquire his investment duplex while representing him against foreclosure. But the Austin lawyer counters that the ex-client agreed to sell the property to pay his attorney fees, but now he's trying to take it back.

The two sides—client Ray McMackin and attorney Jeffrey Kelly—told their varying stories in separate lawsuits progressing through Travis County district court. Both sides have denied all of the allegations in the other party's lawsuit.

“He [McMackin] said, 'Why don't I just sell you this property, if you can get it out of foreclosure? That's what I did. … That's what it was supposed to be for was ongoing attorney fees. He had a multitude of matters that we worked on for him,” said Kelly, owner of The Kelly Legal Group. “He's now trumped up this whole 'I was managing the property for him'—there is not one note, one email, one recorded phone call—nothing—that ever discussed management. It's never what it was.”
