Jason S. Nardiello has joined Bell Nunnally & Martin in Dallas as a partner in the firm's intellectual property practices. Nardiello previously was a partner in Barclay Damon in Syracuse, New York, and headed the firm's trademark and copyright practice. He focuses on litigation, with an emphasis on trademark, copyright and unfair competition law.
Zachary W. Gaver has joined Thompson & Knight as an associate in the oil and gas practice group in the firm's Houston office. He counsels public and private clients, including exploration and production companies, drilling contractors and service providers on a variety of energy transactions.
Appointment
Amy M. Stewart, founding partner of Stewart|Bradbury in Dallas, has been appointed as 2018-2019 Division V director of the American Bar Association's Section of Litigation. Stewart also is cochair of the ABA Section of Litigation's Professional Success Summit scheduled Nov. 14-16 in Houston.
Honors
Becky Diffen, a partner in McGuireWoods in Austin, has been selected for inclusion on A Word About Wind's “Top 100 Legal Power List” recognizing legal professionals whose work has influenced the global wind power market. Diffen, a transactional attorney, chairs the firm's renewable energy group. She is a co-author of “Wind Law,” a legal treatise updated annually that covers environmental, siting and regulatory issues, federal and state incentives and transactional topics relevant to the renewable energy industry.
Richard E. Schellhammer and Cara Kennemer, construction law attorneys with the Underwood Law Firm in Fort Worth, are included in the 2019 edition of The Best Lawyers in America.
Greg McAllister, an attorney with Littler Mendelson in Dallas, has been accepted into the Leadership Dallas Class of 2019. The leadership development program, sponsored by the Dallas Regional Chamber, supports leaders committed to positive change in Dallas. Driscoll from Wilmer Cutler Pickering Hale and Dorr have stepped in to represent Symbotic Inc., an A.I.-enabled technology platform that focuses on increasing supply chain efficiency, and other defendants in a pending shareholder derivative lawsuit. The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays. The case, assigned to U.S. District Judge Nathaniel M. Gorton, is 1:24-cv-12522, Austen v. Cohen et al.

The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M. Berke on behalf of former employee George Edward Steins, who was arrested and charged with employing an unregistered home improvement salesperson. The complaint alleges that had Sunrun informed the Connecticut Department of Consumer Protection that the plaintiff's employment had ended in 2017 and that he no longer held Sunrun's home improvement contractor license, he would not have been hit with charges, which were dismissed in May 2024. The case, assigned to U.S. District Judge Jeffrey A. Meyer, is 3:24-cv-01423, Steins v. Sunrun, Inc. et al.
